Terms & Conditions

1. Agreement

These Terms & Conditions ("Terms") form a binding agreement between you ("you", "the user") and Rahul Gautam, sole proprietor operating the OG Fit application at https://ogfit.pro/ and on Google Play ("OG Fit", "we", "us"). By creating an account or otherwise using OG Fit, you confirm that you have read, understood and accept these Terms, our Privacy Policy, Acceptable Use Policy, Cookie Policy and AI Usage Policy, which are incorporated by reference. If you do not accept them, you must not use the App.

2. The service

OG Fit is a personal fitness and gym tracking application, available as a web app at ogfit.pro and as a native Android app distributed on Google Play. It allows you to log rest, gym and cardio days, select muscle groups, record exercises, sets, repetitions and weights, time your workouts and rest intervals, create custom exercises, and view streaks, calendars, history and statistics derived from the data you enter.

The service is provided on a software-as-a-service basis and is offered "as is" and "as available". We may add, modify, suspend or withdraw features at any time.

3. Eligibility

You must be at least 13 years old to use OG Fit. If you are under the age of majority or under the age of digital consent in your jurisdiction, you may use the App only with the consent and supervision of a parent or legal guardian, who accepts these Terms on your behalf. You must also have the legal capacity to enter into this agreement and must not be barred from using the service under applicable law.

4. Accounts and authentication

  • Accounts are created exclusively through Google Sign-In, authenticated via Firebase Authentication. We do not issue or store passwords.
  • You are responsible for maintaining the security of the Google account you use to sign in, and for all activity that occurs under your OG Fit account.
  • You must provide accurate information and keep it up to date.
  • One account per person. Accounts are personal and may not be shared, sold or transferred.
  • Notify us at app@ogfit.pro immediately if you suspect unauthorised access.

5. Your content

"User Content" means everything you submit to the App: workouts, sets, notes, custom exercises and body metrics.

  • You own your User Content. We claim no ownership over it.
  • You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce, transmit and display your User Content solely for the purpose of operating and providing the service to you — for example, to render your charts, calendars and history. This licence exists only for as long as your content is on our systems and ends when you delete it.
  • You are solely responsible for your User Content and confirm that you have the right to submit it and that it does not infringe any third-party rights or applicable law.
  • Custom exercises you create are private to your account and are stored separately from the built-in exercise library.
  • We may remove User Content that violates these Terms or the Acceptable Use Policy.

6. Acceptable use

You agree to use OG Fit lawfully and in accordance with our Acceptable Use Policy. Prohibited activities include, without limitation:

  • attempting to access, query or modify another user's data, or bypassing authentication or the Firestore security rules that isolate each account
  • reverse engineering, decompiling, scraping, or using automated agents, bots or crawlers against the service without written permission
  • probing, penetration testing, overloading, denial-of-service attacks, or otherwise interfering with the availability or integrity of the service
  • uploading malware, or content that is unlawful, defamatory, obscene, hateful, harassing or infringing
  • reselling, sublicensing, white-labelling or commercially exploiting the App without our written permission
  • misrepresenting your identity or impersonating any person or entity
  • using the App to provide regulated medical, diagnostic or clinical services

Violation may result in immediate suspension or termination.

7. Intellectual property

All rights, title and interest in the OG Fit application — including its source code, design system, branding, name, logo, user interface, built-in exercise library and accompanying documentation — are and remain the exclusive property of Rahul Gautam or his licensors, and are protected by copyright, trade mark and other intellectual property laws.

Subject to these Terms, you are granted a personal, limited, revocable, non-exclusive, non-transferable licence to access and use the App for your own non-commercial fitness tracking. No other rights are granted, whether by implication, estoppel or otherwise. You may not copy, modify, distribute, sell, lease, create derivative works from, or remove any proprietary notices from any part of the App.

Third-party libraries and assets used in the App remain the property of their respective owners and are used under their respective licences.

8. Pricing, subscriptions and refunds

OG Fit is currently offered free of charge. We reserve the right to introduce paid plans, premium features or subscriptions in future.

If and when paid plans are introduced:

  • prices, billing frequency, applicable taxes (including Indian GST where applicable) and the features included will be clearly presented before you are asked to pay;
  • existing users will receive reasonable advance notice, and features you already rely on will not be moved behind a paywall without notice;
  • subscriptions renew automatically unless cancelled before the end of the then-current billing period, and you may cancel at any time from your account settings, with access continuing until the end of the paid period;
  • refunds will be governed by the Refund Policy in force at the time of purchase;
  • payments will be handled by a reputable third-party payment processor (or the Google Play billing system for the Android app); we will not store your full card details.

9. Availability, changes and beta features

We do not guarantee uninterrupted or error-free operation. The service may be unavailable due to maintenance, updates, infrastructure incidents or events outside our control. We may modify, suspend or discontinue any feature, or the App as a whole, at any time. Where we discontinue the service entirely, we will give reasonable notice and a means to export your data where practicable. Features marked as beta or experimental are provided for evaluation and may change or be withdrawn without notice.

10. Third-party services

The App relies on third-party services including Google Sign-In and Firebase Authentication, the Firestore database and Cloud Functions on Google Firebase / Google Cloud Platform, Google Play (for distribution of the Android app), and application hosting infrastructure for the website. Your use of those services may be subject to their own terms. We are not responsible for the acts, omissions, availability or content of third parties.

11. Health and fitness disclaimer

OG Fit is a tracking tool, not a medical service. We are not doctors, physiotherapists, dietitians or certified trainers, and nothing in the App constitutes medical advice, diagnosis, treatment or a personalised training prescription. Statistics, estimated one-rep maxes, streaks and insights are informational estimates derived from data you enter and may be inaccurate.

Physical exercise carries inherent risk of injury or death. Consult a qualified healthcare professional before beginning, changing or intensifying any exercise programme, particularly if you have a medical condition, are pregnant, are recovering from injury, or are taking medication. You exercise entirely at your own risk and assume full responsibility for your training decisions.

12. Disclaimer of warranties

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted or error-free operation. We do not warrant that the App will meet your requirements, that data will always be preserved without loss, or that defects will be corrected. You are responsible for maintaining your own copies of important data via the export feature.

13. Limitation of liability

To the maximum extent permitted by applicable law:

  • we shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, goodwill, data, training history, or business opportunity, arising out of or in connection with your use of or inability to use the App, even if advised of the possibility of such damages;
  • we shall not be liable for personal injury, illness or death resulting from physical exercise undertaken by you, whether or not logged in the App;
  • our total aggregate liability arising out of or relating to these Terms or the App shall not exceed the greater of (a) the total amount you have paid us for the App in the twelve (12) months preceding the event giving rise to the claim, or (b) INR 1,000.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by our negligence. Some jurisdictions do not allow certain exclusions; in those jurisdictions our liability is limited to the smallest extent permitted by law.

14. Indemnity

You agree to indemnify and hold harmless Rahul Gautam and any affiliates, contractors and service providers from and against any claims, damages, liabilities, losses and reasonable legal costs arising out of your User Content, your breach of these Terms or the Acceptable Use Policy, or your violation of any law or third-party right.

15. Suspension and termination

You may stop using the App and delete your account at any time from Settings → Delete account. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or if we reasonably believe your use poses a security or legal risk. On termination, the licence granted to you ends immediately and your data will be handled in accordance with the retention rules in the Privacy Policy. Sections that by their nature should survive termination (including intellectual property, disclaimers, liability, indemnity and governing law) will survive.

16. Force majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, epidemics, war, civil unrest, government action, strikes, internet or hosting provider failures, power outages or cyber attacks.

17. Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) are governed by and construed in accordance with the laws of India. The courts at Meerut, Uttar Pradesh, India shall have exclusive jurisdiction, save that if you are a consumer resident in the EEA, the UK or another jurisdiction whose mandatory consumer law grants you the right to bring proceedings in your place of residence, that right is not affected.

18. Dispute resolution

Before commencing formal proceedings, please contact us at app@ogfit.pro so we can attempt to resolve the matter informally. We will make good-faith efforts to resolve any dispute within 30 days of receiving written notice.

19. General

  • Entire agreement. These Terms together with the policies referenced in them constitute the entire agreement between you and us regarding the App.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
  • No waiver. Failure to enforce any provision is not a waiver of it.
  • Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets, on notice to you.
  • Changes. We may amend these Terms. Material changes will be notified in the App or by email at least 14 days before taking effect, and continued use after that date constitutes acceptance.
  • Language. These Terms are drafted in English; any translation is for convenience only.
